Anyway, I listened to it today. I haven't heard that many of these, so my opinion isn't that informed, but FWIW, Gilmore's lawyer didn't seem to me to come off as well as the government's lawyer. He didn't seem to be able to get the judges to stop any particular line of questioning, which suggests to me that they weren't satisfied with his answers. That said, it seemed--again to my uninformed ears--that the judges were less trying to figure out whether to dismiss the case outright so much as whether they should remand it to the lower court or whether they had jurisdiction themselves.
